APP PRIVACY POLICY

IMPORTANT LEGAL NOTICE: ALL USERS OF THE CATAPULT NATIVE-BRANDED APP ARE SUBJECT TO THE TERMS OF USE, INCORPORATED HEREIN, AS WELL AS THESE PRIVACY POLICIES. BY USING THE CATAPULT NATIVE-BRANDED APP, YOU AGREE TO BE BOUND BY THESE POLICIES.

IMPORTANT LEGAL NOTICE FOR CATAPULT NATIVE-BRANDED APP CLIENTS AND USERS

INTRODUCTORY PROVISIONS

The CATAPULT native-branded APP (“CATAPULT APP”) is owned and operated by DIVERSE NETWORK ASSOCIATES, INC., a California corporation D/B/A “Catapult K12” (“CATAPULT”). This document sets forth the Privacy Policy (the “Policy”) for the CATAPULT APP. Each person who uses the CATAPULT APP is known herein as the “User” or “Users.” CATAPULT reserves the right, at its sole discretion, to modify, add or remove portions of this Privacy Policy from time to time. We will note any such changes by updating the publication date of this Privacy Policy. It is each User’s responsibility to check this Policy periodically for changes. The continued use of the CATAPULT APP following the posting of any changes to this Policy constitutes each User’s acceptance of those modifications, additions, deletions, or changes.

PART 1: CATAPULT APP STORES ONLY DEVICE ID DATA, NOT PERSONAL DATA

A User does not need to provide any personal information in order to use the CATAPULT APP. The APP stores only a user’s communication preferences, identified by the device ID of the user’s phone or other device, so that the system can correctly send the user’s requested notifications (for example: announcements for a particular school). These communications preferences are not tied to any information that could be used to identify any person.

PART 2: CATAPULT APP USE OF GENERAL USER DATA

The CATAPULT APP may gather anonymous use information to develop statistics for internal analytics purposes, showing patterns of general user activity and all other forms of User analytics and to allow us to understand how users interact with the CATAPULT APP, in order to improve the User experience.

PART 3: COOKIES AND POP-UP ADS

CATAPULT reserves the right to send Users various sources and forms of notices, push-notices, “cookies” or pop-up tiles on or through the CATAPULT APP. These forms of communications may track general use information, which may be used to improve User experience, but the CATAPULT APP will not push advertisements to Users. CATAPULT reserves the right to use the tracking and other data gained from these processes. Users have the right to disable many of these pop-ups and instructions.

PART 4: THIRD PARTIES

Because no personal User information is collected, CATAPULT cannot sell, rent, or exchange personal Information for marketing purposes or otherwise. CATAPULT will never sell, rent, or exchange any stored device ID Information for marketing purposes or otherwise. CATAPULT may coordinate with third party vendors, hosting partners, and analytic companies to provide the necessary technology required to perform the CATAPULT APP Services. These companies receive no personal User information in order to provide these services to us. The CATAPULT APP may sometimes provide links to third party websites. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

PART 5: GENERAL PROVISIONS

Venue and applicable law shall be as provided in the Terms & Conditions of Use, incorporated by this reference for all purposes.

PART 6: CHANGE OF BUSINESS

If CATAPULT is involved in a merger, acquisition, or sale of all or a portion of our assets, including in the case of a bankruptcy, our client agencies/institutions will be notified via email of any change in ownership. In such a case, a successor entity will adhere to the terms of this privacy policy with regard to the previously collected information.

PART 7: DATA BREACH PRACTICES

If CATAPULT knows of a systems security breach by an unauthorized party or that any User data was used for an unauthorized purpose, we will comply with relevant state and other data breach laws. We will notify our client agency/institution of any breach resulting in unauthorized release of data electronically, at minimum, and without unreasonable delay, so that Client can take appropriate steps.
